The CEO of Commodore Perry FCU in Ohio has apparently received word that NCUA Region III folks, in a surprise move, will not only formally acknowledge his exam appeal rights; but will also, as a sign of mutual respect, be sending along their thanks....

Chain Reaction...



Dear CPFCU,

Thank you for submitting the detailed 350 page report, describing the alledged misrepresentations, falsifications and subsequent retaliation that occurred during your recent Region 3 exam conducted by our supervisory examiner , The Liquidator (ain't he something!).  

Prior reviews found...
The few parts of the report which we actually reviewed, we found to be quite amusing. Surely you know that to date NCUA has never made a mistake in connection with the exam process. This statement is clearly validated by the fact that there have been only four CU appeals - up the full chain of command - at NCUA in our entire history. And, our review of those four appeals most certainly confirmed, beyond doubt, that the CEOs filing those complaints were either 1) foolish or 2) just plain stupid (and generally we felt they were both.)

 Really, can you imagine the arrogance of those "provincial yahoos" in thinking that we would convict ourselves ?!  I mean, how do they think this Agency actually works anyway ?  Are they stuck on stupid? Do they really believe we care what they think ?

As to your appeal, we're not about to endanger our perfect examination record by permitting anyone, including CPFCU, to try to confuse us with a bunch of facts. To quote our Big Boss: "It ain't happening." And, he swore before Congress back in February that we didn't have to give you nor anyone else a reason for the way we act. He hasn't changed his mind since then, hasn't changed it in over 34 years!  

So, hope you can see why we have found, based on your appeal,  that you are either 1) foolish or 2)  just plain stupid (and generally we felt you were both.) And by the way, the boys over at OIG have confirmed that when they get around to taking a look at your appeal, they too will agree with our conclusion.

So based on our finding that you appear to be both foolish and just plain stupid, we believe that your credit union is unsafe and unsound; and therefore represents a threat to the insurance fund.

Given the extraordinary reputation risk which you represent to the Fund, a "colonoscopical" exam team will hand-deliver to you shortly our formal response to your 1) foolish and 2) just plain stupid appeal.

We feel certain that our "reaction" will preclude your need...

From CU Times ( October 11, 2012)

"An NCUA examiner who witnesses said allegedly called himself "The Liquidator" and made inappropriate statements to four female employees did not harass or retaliate against a small Ohio credit union [Commodore Perry FCU], the Agency said."

"When the same examiner returned to the credit union in 2012 and exhibited the same behavior, the employees were asked to provide written statements regarding the alleged inappropriate incidents."

"Renz said he and Barr [The President and CEO of CPFCU] had concerns about the examiner from the very beginning of the exam, after he initially introduced himself to them as "The Liquidator"."

"He was serious," Renz said.  "He said he was known in his years in the industry as "The Liquidator". I clearly remember that, and took it as his point being, "don't mess with me".

Just for the record "The Liquidator" is a real and well-known NCUA supervisor in Region 3 .  The folks at CPFCU are not making this up.... despite the "findings" of the O.I.G. 

NCUA also knows of the antics of "The Liquidator", yet does nothing other than hide its growing loss of credibility behind a "No Comment" shield from guilt - and accountability.

While yet another credit union and its employees pay the price for telling the truth....

"In other NCUA news, the Office of Inspector General [OIG} found nothing to substantiate accusations by Commodore Perry FCU that their examiner was harassing the credit union's employees [guess you just can't trust the affidavits of four female employees] and subsequently lowered the credit union's CAMEL rating when it was reported."


Duel " chartering in NC........
"The Supervisory Review Committee that could review the case is also within the NCUA, so results will be suspect, particularly since the regional director who declined to send a different examiner to the credit union, Herb Yolles, is the same one who made the retaliatory call for dual exams for all state-chartered credit unions in North Carolina after SECU was permitted by the state regulator [ in accordance with NC state law] to release its state CAMEL rating."

"He [Yolles] also accused N.C. regulator Jerrie Jay of stating that the NCUA had begun terminating SECU's insurance, which recordings later proved she did not.  However, the OIG yet again let an NCUA employee off with a free pass finding it was a misinterpretation."

Wanna guess who was the former head of the OIG at NCUA....??
